I would like to underscore your warning to contractors to review their contracts and become better informed about their risks.  And, on the other side, it is a lesson for the indemnitors--I doubt, for example, the homeowner&#039;s association took into account the potential risks associated with the run-off.   And, as maintenance of the detention ponds could have been a factor in the run-off which, possibly, could have exposed the association to some of the liability (or maybe all of the liability under the indemnifcation).
